Katy Perry has won the copyright battle over her song “Dark Horse.” the writers of Katy’s song “Dark Horse” were found by a jury to have infringed on the copyright of Flame’s song “Joyful Noise.” Flame was $2.78 million, but now a judge has thrown out the ruling.

U.S. District Court Judge Christina Snyder ruled the evidence presented in the case didn’t show the defendants, Katy, Capitol Records, and Lukasz "Dr. Luke" Gottwald, had ripped off the rapper. She ruled that none of the elements of "Joyful Noise," including pitch sequence and the temporal spacing of notes, was protectable.

The judge noted, “the signature elements of the 8-note ostinato in 'Joyful Noise'... is not a particularly unique or rare combination.” The judge added that even if she didn’t come to that conclusion, she would have ordered a new trial regarding damages.
